2. SMS Messaging Terms

Program Name

Braco Generators, LLC Customer Communications

Program Description

The Braco Generators messaging program sends text messages to customers and prospective customers who have expressly opted in to receive communications from us.

Depending on the type of consent provided, messages may include:

  • Responses to customer inquiries
  • Quote and consultation follow-ups
  • Appointment confirmations
  • Appointment reminders
  • Scheduling and rescheduling notices
  • Generator installation updates
  • Service and maintenance reminders
  • Customer-support communications
  • Warranty-related updates
  • Payment or account notices
  • Requested product information
  • Occasional promotions or special offers when separate marketing consent has been provided

Consent to receive marketing text messages is not a condition of purchasing products or services from Braco Generators.

How Customers Opt In

Customers may opt in through one or more of the following methods:

  • Completing a website form and affirmatively selecting an unchecked SMS-consent box
  • Completing an online scheduling or consultation form with a dedicated consent option
  • Signing a written or electronic consent form
  • Providing documented verbal consent when legally permitted
  • Sending an approved opt-in keyword to a Braco Generators telephone number
  • Otherwise providing clear, affirmative, and verifiable consent

Providing a telephone number without selecting or agreeing to the accompanying SMS disclosure does not automatically enroll a person in recurring text messaging.

If Braco Generators offers both informational and marketing text messages, customers may be provided with separate consent options for each category.

Message Frequency

Message frequency varies depending on:

  • The customer’s inquiry
  • Appointment activity
  • Installation or service status
  • Maintenance schedule
  • Account activity
  • Customer-support needs
  • Communication preferences
  • Whether marketing consent has been provided

Recurring messages may be sent. Braco Generators does not guarantee or promise a fixed number of messages.

Message and Data Rates

Message and data rates may apply.

Charges are determined by your wireless carrier and mobile service plan. Braco Generators does not charge a separate subscription fee for its text-messaging program.

Opt-Out Instructions

You may cancel text messages at any time by replying STOP to the telephone number that sent the message.

Supported opt-out requests may include:

  • STOP
  • CANCEL
  • END
  • QUIT
  • UNSUBSCRIBE
  • REVOKE
  • OPT OUT

After submitting an opt-out request, you may receive one final confirmation message stating that you have been unsubscribed. You will not receive additional recurring messages from that program unless you provide new consent.

You may also communicate a reasonable request to stop text messages through another available method. Braco Generators will honor valid opt-out requests as required by applicable law.

Opting out of text messaging does not prevent us from responding through another communication channel when appropriate, such as email, or from contacting you about an active contract, scheduled appointment, safety issue, payment matter, or service you requested, when legally permitted.

Re-Enrolling

After opting out, you may re-enroll by:

  • Completing a new SMS-consent form
  • Using an approved opt-in keyword
  • Providing new written or electronic consent
  • Otherwise completing an authorized opt-in process

Privacy

Our collection and use of personal and mobile information is governed by our Privacy Policy:

https://bracogenerators.com/privacy-policy

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use-case categories exclude text-messaging originator opt-in data and consent; this information will not be shared with any third parties.

3. Website Use

The Braco Generators website is provided for general information, product research, consultation requests, appointment scheduling, and access to our services.

You agree not to:

  • Use the website for unlawful purposes
  • Attempt to gain unauthorized access to the website or connected systems
  • Introduce viruses, malicious code, or other harmful material
  • Scrape or copy website content through automated means without authorization
  • Interfere with the operation or security of the website
  • Submit false, misleading, fraudulent, or unauthorized information
  • Impersonate another person or business
  • Use the website in a manner that infringes another party’s rights

We may restrict or terminate website access when we reasonably believe these Terms have been violated.

4. Website Information Is General Information

Information on our website is provided for general educational and informational purposes.

Website content does not replace:

  • An onsite property evaluation
  • An electrical load calculation
  • A fuel-supply assessment
  • A code review
  • A permit inspection
  • A written estimate
  • Manufacturer documentation
  • Advice from a licensed electrician, plumber, gas professional, engineer, utility company, or code official

Generator specifications, availability, pricing, warranty terms, and product features may change without notice.

5. Generator Sizing Tool

Our online Generator Sizing Tool provides a preliminary estimate based on information selected or entered by the user.

The result is not a final load calculation, engineering determination, guarantee, or installation recommendation.

Actual generator requirements may depend on:

  • Electrical service size
  • Appliance startup loads
  • HVAC specifications
  • Number of electrical panels
  • Fuel availability
  • Gas-pressure requirements
  • Simultaneous electrical demand
  • Existing wiring
  • Transfer-switch configuration
  • Local code requirements
  • Future electrical needs
  • Manufacturer requirements
  • Site-specific conditions

A professional onsite evaluation is required before final equipment selection and installation.

Braco Generators is not responsible for purchasing decisions made solely from the online sizing tool without professional verification.

6. Consultations and Estimates

Initial consultations or estimates may be offered without charge unless otherwise disclosed.

An estimate is based on the information and visible conditions available when it is prepared. Unless expressly stated otherwise, estimates are not guaranteed final prices.

Pricing may change due to:

  • Hidden or inaccessible conditions
  • Electrical-panel deficiencies
  • Code-required upgrades
  • Utility requirements
  • Gas-meter or fuel-system upgrades
  • Trenching or excavation conditions
  • Rock, concrete, landscaping, drainage, or access issues
  • Permit or inspection requirements
  • Customer-requested changes
  • Manufacturer price changes
  • Material availability
  • Additional labor or equipment
  • Incorrect information supplied by the customer

Additional work will generally require customer authorization through a revised estimate, change order, or other written approval.

Estimates are valid only for the period stated in the estimate. If no period is stated, Braco Generators may revise an estimate before it is accepted.

7. Contracts, Deposits, and Scheduling

Generator installations and substantial service projects may require:

  • A signed proposal or agreement
  • A deposit
  • Approved financing
  • Product availability
  • Permit approval
  • Utility coordination
  • Site access
  • Completion of required preparatory work

An appointment request does not guarantee an installation date.

Installation dates are estimates and may be affected by:

  • Weather
  • Equipment availability
  • Manufacturer delays
  • Permit processing
  • Utility scheduling
  • Inspection availability
  • Fuel-provider scheduling
  • Subcontractor availability
  • Unsafe working conditions
  • Events outside our reasonable control

We will make reasonable efforts to communicate material scheduling changes.

8. Cancellation and Rescheduling

Customers should provide reasonable notice when canceling or rescheduling consultations, service visits, or installation appointments.

Deposits, cancellation charges, restocking fees, permit costs, special-order equipment costs, or completed labor may be nonrefundable when disclosed in the applicable proposal or agreement.

Special-order or customized equipment may not be cancelable after it has been ordered.

The cancellation terms in an accepted written proposal, financing agreement, or installation contract will control if they differ from this general section.

9. Product Sales and Delivery

Product descriptions, images, and specifications are provided for reference. Actual products may differ slightly in appearance because of manufacturer changes or production variations.

Product availability and pricing are subject to change.

Delivery-only orders may be subject to:

  • Delivery charges
  • Distance limitations
  • Site-access requirements
  • Curbside or designated-location delivery terms
  • Customer inspection at delivery
  • Manufacturer return restrictions
  • Restocking fees

Free delivery, when offered, may be limited to installations performed by Braco Generators and to our normal service area.

The customer is responsible for confirming that equipment purchased without installation is suitable, code-compliant, and properly installed by qualified professionals.

10. Site Access and Customer Responsibilities

The customer agrees to provide safe and reasonable access to the property, electrical equipment, fuel systems, and installation area.

The customer is responsible for:

  • Providing accurate property and contact information
  • Identifying known underground or concealed utilities when required
  • Disclosing easements, property-line issues, HOA restrictions, or access limitations
  • Securing pets and maintaining a safe work area
  • Removing obstacles when reasonably requested
  • Providing access to electrical panels and utility equipment
  • Obtaining owner, landlord, or association permission when applicable
  • Notifying us of known hazardous conditions
  • Maintaining adequate natural-gas or propane service
  • Ensuring that unrelated work performed by others is completed as scheduled

Braco Generators may suspend work if site conditions are unsafe, inaccessible, materially different from those disclosed, or not ready for installation.

11. Generator Location and Installation Requirements

Generator placement is subject to:

  • Manufacturer clearance requirements
  • National and local electrical codes
  • Fuel-gas codes
  • Fire and building codes
  • Utility requirements
  • Property boundaries
  • Windows, doors, vents, and ignition sources
  • Flood and drainage concerns
  • Inspection requirements
  • Serviceability
  • Homeowner-association restrictions

The customer’s preferred location may not be approved or safe.

The final location will be determined by applicable requirements and site conditions.

12. Generator Pads

A generator pad provides a level and stable mounting surface for the equipment.

The appropriate pad type may depend on:

  • Generator model
  • Soil and drainage conditions
  • Manufacturer requirements
  • Local code
  • Flood exposure
  • Installation location

Ground settlement, erosion, flooding, landscaping changes, animal damage, or work performed by others after installation may affect the pad or generator and may not be covered by a product or workmanship warranty.

13. Electrical and Transfer-Switch Work

Standby generators require an approved transfer switch or another legally permitted transfer method.

The transfer switch helps:

  • Isolate the property from utility power
  • Prevent dangerous backfeeding
  • Transfer electrical loads to the generator
  • Return the property to utility power after restoration

The required transfer switch depends on the generator, electrical service, load-management design, and installation scope.

Existing electrical systems may require repair or upgrades before a generator can be safely connected.

14. Natural Gas and Propane Systems

Standby generators may operate on natural gas or liquid propane when designed and configured for that fuel.

Fuel-system requirements may include:

  • Gas-meter upgrades
  • Regulator changes
  • Increased pipe size
  • Propane-tank installation
  • Fuel-line installation
  • Pressure testing
  • Utility or fuel-provider approval

Fuel availability, pressure, and capacity are the customer’s responsibility unless specifically included in a written agreement.

Braco Generators does not control utility interruptions, propane delivery, fuel quality, or fuel availability.

A generator cannot operate without an adequate and properly maintained fuel supply.

15. Permits, Utilities, and Inspections

Installation projects may require permits, utility coordination, inspections, or approvals.

The responsible party for obtaining permits will be identified in the proposal or agreement.

Permit and inspection timelines are controlled by government agencies, utilities, and inspectors. Braco Generators is not responsible for delays outside its control.

Code officials or utilities may require work beyond the original anticipated scope. Such work may result in additional charges.

16. Whole-House and Partial-House Systems

A whole-house generator is intended to support a broad range of household loads, but the term “whole house” does not guarantee that every appliance can operate simultaneously under every condition.

Performance depends on:

  • Generator output
  • Fuel type
  • Startup loads
  • Load management
  • Electrical demand
  • Appliance condition
  • Installation design

A partial-house or essential-circuit system powers only the circuits identified in the installation scope.

Customers should understand which appliances and circuits are included before accepting the installation proposal.

17. Automatic Operation and Utility Outages

Standby generators are designed to detect qualifying utility-power loss and start automatically when the system is operating normally.

However, no generator can be guaranteed to start or operate under every circumstance.

Operation may be affected by:

  • Insufficient fuel
  • Low battery
  • Lack of maintenance
  • Mechanical or electrical failure
  • Flooding
  • Impact damage
  • Animal intrusion
  • Utility conditions
  • Improper modifications
  • Manufacturer faults
  • Extreme weather
  • Events beyond reasonable control

Braco Generators does not guarantee uninterrupted electricity or uninterrupted operation of any appliance, business, medical device, data system, or property.

Customers with critical medical or life-safety requirements should maintain additional emergency plans and should not rely exclusively on a standby generator.

18. Monitoring Services

Remote monitoring may provide information about generator status, exercise cycles, alerts, or service needs.

Monitoring is a supplemental service and is not a guarantee that:

  • Every condition will be detected
  • Alerts will always be transmitted
  • Internet or cellular service will remain available
  • A technician will respond immediately
  • The generator will operate during an outage

Monitoring depends on compatible equipment, connectivity, third-party platforms, customer account status, and properly functioning hardware.

Customers remain responsible for visually checking their generator and reporting unusual conditions.

19. Maintenance and Repairs

Standby generators require routine maintenance.

Maintenance may include:

  • Oil and filter changes
  • Battery inspection or replacement
  • Air-filter service
  • Spark-plug service
  • Exercise-cycle review
  • Fuel-system inspection
  • Firmware or monitoring review
  • General operational testing

Maintenance frequency depends on the generator model, run time, manufacturer schedule, environment, and usage.

Failure to complete required maintenance may cause equipment failure and may affect warranty eligibility.

Maintenance plans cover only the services expressly listed in the applicable plan or agreement.

Emergency repairs, replacement parts, batteries, fuel-system work, damage, misuse, or non-warranty items may involve additional charges.

20. Manufacturer Warranties

Generator and equipment warranties are provided by the manufacturer and are subject to the manufacturer’s current written terms.

Warranty duration and coverage may vary by:

  • Model
  • Product series
  • Residential or commercial use
  • Registration
  • Installation date
  • Maintenance history
  • Promotional warranty programs

Manufacturer warranties may exclude:

  • Routine maintenance
  • Normal wear
  • Batteries and accessories
  • Improper installation
  • Lack of maintenance
  • Misuse or neglect
  • Unauthorized modifications
  • Overloading
  • Fuel problems
  • Acts of nature
  • Flooding
  • Theft
  • Damage caused by others

Customers should retain invoices, proof of purchase, model information, and maintenance records.

Only covered repairs approved under the applicable manufacturer warranty will be performed without charge.

Braco Generators does not control warranty decisions made by a manufacturer or warranty administrator.

21. Workmanship Warranty

Any Braco Generators workmanship warranty will be described in the accepted written proposal or installation agreement.

A workmanship warranty does not cover:

  • Manufacturer defects
  • Equipment failure
  • Normal wear
  • Customer misuse
  • Work altered by others
  • Utility or fuel-provider issues
  • Landscaping or excavation changes
  • Flooding or natural disasters
  • Existing property defects
  • Conditions outside the original scope

Where an installation contract contains specific warranty terms, that contract controls.

22. Third-Party Products and Services

We may use or recommend products and services provided by manufacturers, utilities, finance providers, payment processors, fuel providers, monitoring platforms, or other third parties.

Third-party products and services are governed by their own agreements, warranties, and privacy policies.

Braco Generators is not responsible for:

  • Third-party service interruptions
  • Financing decisions
  • Utility delays
  • Manufacturer platform outages
  • Monitoring-network failures
  • Third-party website content
  • Fuel-provider performance

23. Financing

Financing, when available, is provided by independent third-party lenders.

Financing is subject to:

  • Credit approval
  • Lender terms
  • Interest rates
  • Fees
  • Payment schedules
  • Eligibility requirements

Braco Generators does not make credit decisions and is not responsible for lender approval, denial, or loan terms.

Customers should review financing documents carefully before signing.

24. Payments

Payment amounts and schedules will be stated in the applicable estimate, invoice, proposal, or agreement.

The customer agrees to pay approved charges when due.

Past-due balances may be subject to:

  • Late charges
  • Collection costs
  • Suspension of services
  • Cancellation of scheduled work
  • Other remedies permitted by law and contract

Disputed charges should be reported promptly.

25. Photographs and Project Documentation

Braco Generators may photograph equipment, installation conditions, or completed work for documentation, warranty, quality-control, training, or safety purposes.

We will seek appropriate permission before using identifiable customer information or private property images for public advertising when required.

Customers may notify us if they do not want nonessential project photographs used publicly.

26. Reviews and User-Submitted Content

If you voluntarily submit a review, testimonial, photograph, video, comment, or other content, you represent that:

  • You own the content or have permission to submit it
  • The content is accurate to the best of your knowledge
  • The content does not violate another party’s rights
  • The content is not unlawful, defamatory, or misleading

When you grant permission for promotional use, you provide Braco Generators a nonexclusive, royalty-free license to reproduce, display, adapt, and distribute the approved content for lawful business purposes.

We will not publish private contact information without authorization.

27. Intellectual Property

The Braco Generators website and its original content, design, graphics, text, logos, photographs, videos, and other materials are owned by or licensed to Braco Generators and are protected by applicable intellectual-property laws.

You may view or print website materials for personal, noncommercial use.

Without written permission, you may not:

  • Copy substantial website content
  • Republish our materials
  • Sell or license our content
  • Create derivative commercial works
  • Remove copyright or trademark notices
  • Misrepresent an affiliation with Braco Generators

Manufacturer names, trademarks, and product images remain the property of their respective owners.

28. Third-Party Links

Our website may link to third-party websites for convenience or additional information.

A link does not necessarily mean that Braco Generators endorses or controls the third party.

We are not responsible for third-party content, availability, privacy, security, terms, products, or services.

29. Disclaimer of Website Warranties

To the fullest extent permitted by law, the website and its general informational content are provided “as is” and “as available.”

We do not guarantee that:

  • The website will always be available
  • Website content will be error-free
  • Every product will be available
  • Online calculators will be exact
  • Third-party links will remain active
  • The website will be free from all harmful components

This disclaimer does not eliminate warranties that cannot lawfully be excluded or any express warranty stated in a signed agreement.

30. Limitation of Liability

To the fullest extent permitted by law, Braco Generators will not be liable for indirect, incidental, special, punitive, or consequential damages arising from use of the website or general website information.

Service and installation liability is governed by the applicable signed proposal, contract, warranty, and law.

Nothing in these Terms excludes liability that cannot legally be limited or excluded.

31. Indemnification

You agree to indemnify and hold Braco Generators, its owners, employees, agents, and contractors harmless from claims, losses, liabilities, and expenses arising from:

  • Your unlawful use of the website
  • Information you submit without authorization
  • Your violation of these Terms
  • Your infringement of another party’s rights
  • Unsafe or undisclosed property conditions caused or controlled by you

This provision does not apply to the extent a claim was caused by Braco Generators’ own legally established fault.

32. Events Beyond Our Control

Braco Generators is not responsible for delay or nonperformance caused by events beyond our reasonable control, including:

  • Severe weather
  • Natural disasters
  • Utility outages
  • Supply-chain disruptions
  • Manufacturer delays
  • Labor shortages
  • Government action
  • Permit or inspection delays
  • Transportation disruptions
  • Fire
  • Flood
  • Epidemics
  • Civil unrest
  • War
  • Internet or telecommunications outages

We will make reasonable efforts to resume affected work when conditions permit.

33. Governing Law

These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law principles.

Unless a separate signed contract requires another process, disputes relating to these Terms will be handled in a court of competent jurisdiction located in Missouri.

Nothing in this section prevents the parties from mutually agreeing to mediation or another voluntary dispute-resolution process.

34. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in effect.

The invalid provision will be interpreted or modified only to the minimum extent necessary to make it enforceable where permitted.

35. No Waiver

Failure by Braco Generators to enforce a provision of these Terms does not waive our right to enforce it later.

36. Entire Agreement

These Terms, our Privacy Policy, and any applicable accepted proposal, invoice, financing agreement, maintenance plan, warranty, or installation contract constitute the relevant agreement between the parties.

When a signed project agreement conflicts with these general website Terms, the signed project agreement controls for that project.

37. Changes to These Terms

We may update these Terms periodically to reflect changes in:

  • Our business
  • Products and services
  • Messaging practices
  • Technology
  • Legal requirements
  • Carrier requirements

The updated version will be posted on our website with a revised effective date.

Continued website use after changes become effective constitutes acknowledgment of the revised Terms to the extent permitted by law.
